General Purchasing

By placing an order with Upper Dhali®, you agree to purchase products subject to these Terms & Conditions.

When purchasing, you must provide accurate and complete information. Please ensure all details are correct at the time of purchase, as changes may not be possible once an order has been processed.

A contract for the purchase of goods is formed once payment has been received and accepted by Upper Dhali®. We reserve the right to refuse or cancel any order prior to dispatch, including where products are unavailable, pricing errors have occurred, fraudulent activity is suspected, or circumstances arise that prevent us from fulfilling the order.

Ownership of goods passes to you upon delivery.

Handmade Products

All Upper Dhali® products are individually handcrafted. Due to the handmade nature of our products, slight variations may occur between pieces, including but not limited to fabric placement, embroidery, embellishments, colour tones, sizing and finishing details.

These variations are a natural part of the handcrafted process, contribute to the uniqueness of each piece, and are not considered faults or defects.

Product photographs are provided as accurately as possible; however, colours may appear differently depending on individual screen settings and device displays.

Made To Order & Bespoke Services

Made-to-order items include commissions, bespoke, custom or personalised products. These orders are subject to the following conditions:

  • Any booking deposit paid to secure a made-to-order item is non-refundable.
  • Prior to commencement, Upper Dhali® will provide a design inspiration board for approval where applicable.
  • Design changes requested after approval may incur additional design fees.
  • Full payment (cleared funds) is required before work commences on bespoke products unless otherwise agreed in writing.
  • Written client approval via email is required before dispatch.
  • Once final approval has been provided, further changes may not be possible.
  • Items will generally be shipped within two business days of final approval.
  • Change-of-mind refunds are not available for personalised, custom-made or made-to-order products, in accordance with Australian Consumer Law.

Lead times provided for made-to-order products are estimates only. Completion dates may vary due to material availability, supplier delays, illness, family emergencies, postal disruptions or other circumstances beyond our reasonable control.

Pricing

All prices are listed in Australian Dollars (AUD). Upper Dhali® is not currently registered for GST and no GST is included in the prices displayed. Postage and handling charges are additional and payable in full prior to dispatch.

Prices may change without notice. While every effort is made to ensure pricing and product information is accurate, Upper Dhali® reserves the right to correct errors, inaccuracies or omissions and to cancel affected orders.

Where payment has already been received for an affected order, a full refund will be issued using the original payment method.

Intellectual Property

All content on this website, including but not limited to text, images, photographs, artwork, designs, products, logos, trademarks and graphics, is protected by Australian and international intellectual property laws.

Content is provided for personal, non-commercial use only. You must not reproduce, modify, distribute, publish, sell, copy or create derivative works from any content or product without prior written consent from Upper Dhali®.

Upper Dhali® and associated logos are registered trademarks in Australia.

Website Security & Indemnity

While reasonable precautions are taken to maintain the security of this website, data transmission over the internet cannot be guaranteed as completely secure.

You are responsible for maintaining appropriate safeguards when accessing this website, including the use of current antivirus and security software.

To the extent permitted by law, you agree to indemnify Upper Dhali® against any loss, damage, liability, cost or expense arising from your misuse of this website or breach of these Terms & Conditions.

Force Majeure

Upper Dhali® will not be liable for any delay or failure to perform its obligations where such delay or failure results from events beyond our reasonable control, including but not limited to natural disasters, floods, storms, bushfires, pandemics, power outages, supplier shortages, industrial disputes, transport disruptions or government actions.

Where such events occur, we will make reasonable efforts to communicate delays and fulfil affected orders as soon as practicable.

Disclaimer & Limitation of Liability

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy available under the Australian Consumer Law or any other applicable legislation.

To the extent permitted by law, where liability cannot be excluded, Upper Dhali® limits its liability to one or more of the following remedies at its discretion:

  • Repair of the product;
  • Replacement of the product;
  • Resupply of the product; or
  • Refund of the purchase price paid.

To the extent permitted by law, Upper Dhali® is not liable for any indirect, incidental or consequential loss arising from the use of our products or website.

Governing Law

These Terms & Conditions are governed by the laws of Queensland, Australia.

Any disputes arising in connection with these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of Queensland.

Changes To These Terms

Upper Dhali® reserves the right to amend these Terms & Conditions at any time. Updated versions will be published on this page and take effect from the date of publication.
