GENERAL PURCHASING

By placing an order with Upper Dhali®, you agree to purchase products subject to these Terms & Conditions.

When purchasing, you must provide accurate and complete information, including your full name, delivery address, email address, telephone number, and payment details. Please ensure all details are correct at the time of purchase, as changes may not be possible once an order has been processed.

A contract for the purchase of goods is formed once payment has been received in full. Title to goods passes to you upon receipt of payment.

You may request cancellation of your order within 24 hours of purchase. Any applicable cancellation or restocking fees will apply.

Risk of loss or damage to goods passes to you upon dispatch, to the extent permitted by law.

From time to time, Upper Dhali® may offer purchases via invoice or custom website listings. These invoices or listings are valid for 24 hours only. If payment is not received within this timeframe, the invoice or listing will expire and any associated special terms will become void.

Upper Dhali® reserves the right to refuse service to any individual or business, provided such refusal does not breach Australian anti-discrimination laws.

MADE TO ORDER & BESPOKE SERVICES

Made-to-order items include commissions, bespoke, custom, or personalised products. These orders are subject to the General Purchasing terms above, in addition to the following conditions:

  • Any booking deposit paid to secure a made-to-order item is non-refundable.

  • Prior to commencement, Upper Dhali® will provide a design inspiration board for approval.

  • Design changes requested after approval may incur additional design fees.

  • Full payment (cleared funds) is required before work commences on bespoke products.

  • Written client approval via email is required before dispatch.

  • Items will be shipped within two business days of final approval, or on the next available shipping day.

Change-of-mind refunds are not available for made-to-order or personalised items, in accordance with Australian Consumer Law.

PRICING

All prices are listed in Australian Dollars (AUD) and are exclusive of Goods and Services Tax (GST), unless otherwise stated.

Postage and handling charges are additional and payable in full prior to dispatch.

Prices may change without notice. Upper Dhali® is not liable for price changes, modifications, suspensions, or discontinuation of products or services.

While we take care to ensure accuracy, errors may occur. Upper Dhali® reserves the right to cancel orders affected by pricing or listing errors. If payment has already been made, a full refund will be issued via the original payment method.

REFUNDS & EXCHANGES

Refunds and exchanges are governed by our Refunds & Exchanges Policy, which should be read in conjunction with these Terms.

Nothing in these Terms excludes or limits your rights under Australian Consumer Law.

PRIVACY

Your personal information is handled in accordance with our Privacy Policy.

INTELLECTUAL PROPERTY

All content on this website — including text, images, designs, products, logos, trademarks, and graphics — is protected by intellectual property laws.

Content is provided for personal use only. You must not reproduce, modify, distribute, commercialise, or create derivative works from any content or product without prior written consent.

Upper Dhali® and associated logos are registered trademarks in Australia.

WEBSITE SECURITY

While reasonable precautions are taken, data transmission over the internet cannot be guaranteed as secure. You are responsible for maintaining appropriate safeguards when accessing this website.

Upper Dhali® is not liable for interference, damage, or loss arising from use of this website or linked third-party websites, to the extent permitted by law.

INDEMNITY

To the extent permitted by law, you agree to indemnify Upper Dhali® against losses, damages, claims, costs, and expenses (including legal fees) arising from your use of this website or breach of these Terms.

VARIATION

Upper Dhali® may amend, update, or replace these Terms & Conditions at any time. The version published on our website at the time of purchase will apply.

DISCLAIMER & LIMITATION OF LIABILITY

To the extent permitted by law, Upper Dhali® excludes all warranties not expressly stated in these Terms.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or right under Australian Consumer Law.

Where liability cannot be excluded, our liability is limited (at our option) to repairing, replacing, or refunding the product.

Upper Dhali® is not liable for indirect or consequential loss, to the extent permitted by law.
